<p>A recent article in the Los Angeles Times was alarming to many California employers as it stated “California businesses recently learned that their workers&#8217; compensation (WC) insurance premiums could swell this summer.” (To read the articles from Los Angeles Times, please click <a rel="nofollow" onclick="javascript:pageTracker._trackPageview('/outgoing/article_exit_link');" href="http://www.latimes.com/business/la-fi-comp6-2009apr06,0,3889432.story" target="_blank">here</a>.) The article explained that a state board charged with tracking WC expenses recommended a rate increase of 24% based on rising costs such as: higher medical expenses, the threat of increased payments to permanently disabled workers, and sharp increases to medical cost containment and medical legal costs. Many employers know they must pay for WC insurance but may not know how the premium is calculated and/or what they can do to keep their premiums as low as possible, which will be the focus of this article.</p>
<p>What exactly is workers compensation? Workers compensation is a state-mandated, &#8220;no-fault&#8221; insurance system that pays benefits to workers injured on the job to cover medical care, supplement lost wages, and to settle any permanent disability claims. In return, employers are generally entitled to immunity from civil lawsuits that employees might have as a result of their on-the-job injuries.</p>
<p>How are WC premiums calculated? Each occupation is generally assigned a risk classification, determined by two historical factors: the frequency of on-the-job injuries within a particular occupation and the average severity of injuries suffered. Severity is measured by the medical costs (to return a worker back to the workplace) and any payments made directly to the injured employee (in connection with benefits provided through the workers’ compensation system).</p>
<p>To arrive at a base rate for workers&#8217; compensation insurance in California, each risk classification is translated into a dollar amount, which is then multiplied by 1% per $100 of the total payroll for that employee. For example, an office clerk’s compensation rate could be calculated at roughly $1.25 per every $100 that employee’s payroll may total.  If the office clerk is paid $500 per week, the WC insurance premium for that employee costs an employer roughly $6.25 per week.</p>
<p>The base premium for your policy is then multiplied by your experience modification (ex mod) to get your actual premium.  For example: If the total base premium for your entire policy is $5,000 per year and your ex mod is 1.2%, the total premium would be $5,000 multiplied by 1.2%, or $6,000. </p>
<p>How is the Experience Modification (ex mod) calculated? The WC ex mod is calculated based on three years of experience (annual payroll and losses), not including the most recent year. The ex mod for 2009 would be based upon loss experience, plus payroll records reflected from 2005 through 2007. The ex mod calculation is based on what has been paid and any money the insurance carrier has set aside or reserved to resolve open claims. Reserves reflect only an estimation of what a carrier believes will be paid and do not necessarily reflect the actual amount that will be paid once the claim is closed.</p>
<p>How can an employer reduce/limit WC premiums?  There are many ways to help reduce the cost of WC premiums. Employers can reap the rewards of ensuring job classifications and payroll records are accurate; invest in aggressive safety programs that reward good and safe workplace practices; create opportunities for modified work programs to help return workers to productive; and closely monitor open claims and reserves. </p>
<p>Above all, do not allow your cost saving interests get ahead of good claims practices. Time and time again, the news will feature an employer who thought that by simply understating the number of employees they had and/or under reporting payroll, they could enjoy a discount in payroll.  However, this practice is considered as insurance fraud and carries severe penalties for those who perpetrate this act. Below are some excerpts from the Los Angeles Times which highlight how this seemingly good idea can go very wrong.</p>
<p> The owner of a security firm and two vice presidents accused of defrauding the state of $9 million in an elaborate workers&#8217; compensation scheme pleaded not guilty.  The men allegedly created a shell company, International Armored Solutions Inc., to hide the true number of employees at the security firm to avoid paying higher WC insurance premiums.  Authorities said state officials were told that the new company employed about 20 workers and it was not part of the main security firm. The company failed to pay $9.5 million in WC premiums for its 1,500 employees and the men were taken into custody Wednesday on suspicion of fraud, prosecutors said.  </p>

              In 1913, the Iowa Legislature passed the law creating Iowa&#8217;s workers&#8217; compensation system.  When the law was passed, there was a trade-off made between employers and employees.  While an employee does not have to prove fault or negligence like they would in a car accident case for example, the trade-off is that the employee&#8217;s damages are limited.  In an Iowa workers&#8217; compensation case, an employee is generally not allowed to recover pain and suffering or loss of quality of life damages against the employer.  The exception to this rule is if you can prove that a co-employee committed &#8220;gross negligence&#8221;.  Also, if you were injured by someone who does not work for your employer or a defective product caused your injuries then you may be entitled to additional damages.  You should consult an attorney to find-out if your case meets one of these criteria.</p>
<p>Another misconception that some injured workers have is that the insurance adjustor is there to help you with your work injury case.  The insurance adjustor works for your employer and/or their insurance company and has no duty to protect your rights or even tell you what the law is.  Also, sometimes a nurse or medical case manager will be assigned to your case.  The nurse will come to your appointments, talk to your doctors and often act like they are your friend.  Keep in mind that they also are working for your employer and/or their insurance company so be careful what you tell them.  They are trained to find things in your past medical treatment and try to use those things against you in your work injury case.  While honesty is always the best policy that does not mean you should tell them your whole life story.  Along the same lines, often people think that they have to let the medical case manager into the examination room.  The answer is no, you do not have to let them in during the examination.  However, under Iowa law they can speak with your doctors and other medical providers when you are not present.</p>
<p>Sometimes clients will come to see me after they have fired an attorney they found in the phone book who advertised as a workers&#8217; compensation attorney.  Any Iowa attorney can advertise that they handle workers&#8217; compensation cases even though they may have never handled a single case.  What you need to look for is an attorney who advertises &#8220;practicing primarily in workers&#8217; compensation&#8221;.  This means that the attorney has certified with the Iowa State Bar Association that at least 40% of their law practice involves workers&#8217; compensation and that they have spent at least 15 hours per year taking continuing education classes about Iowa&#8217;s workers&#8217; compensation laws.  Iowa&#8217;s work injury laws are far too complex for someone without knowledge and experience to represent an injured worker.  Only a qualified Iowa workers&#8217; compensation attorney can make sure that your rights are protected and that you are treated fairly in your case.</p>
<p>Another thing to look for when searching for an attorney is what results they have obtained for their clients and what their past clients have to say.  Don&#8217;t take &#8220;all my cases are confidential&#8221; as an answer.  Ask yourself do you want someone representing you with a proven track record or do you want to take a gamble on the attorney you chose.  If an attorney has obtained good results for past clients and past clients have good things to say, then chances are they are qualified to to represent an injured worker.  Whether you live in Des Moines, Cedar Rapids, Waterloo, Iowa City, Ft. Dodge, Marshalltown or even outside of the state of Iowa, you should find an experienced Iowa work injury attorney to help you.</p>
<p>Clients often wonder how they can afford to hire an attorney to help with their work injury case.  First of all, most qualified Iowa work injury attorneys will provide you with an initial consultation at no cost.  Also, most work injury cases are handled on a contingency fee.  A contingency fee means that if you do not make a recovery then you will not owe any attorney fees.  The attorney being paid is contingent upon you being paid.  As part of the contingency fee, if you are currently receiving weekly benefits then the attorney should not charge you any fee on those benefits.  Also, if the doctor provided by your employer and/or their insurance company (the company doctor) provides you with a permanent impairment rating your attorney should not take a fee on those benefits.  If through the efforts of the attorney you receive more money than the impairment rating given by the company doctor then the attorney will receive a percentage of the additional money you receive.  Once again I have seen many clients who were not happy with their prior attorney who had been charging them a fee on benefits that were rightfully theirs.  Attorneys who do not routinely handle workers&#8217; compensation cases will sometimes take a fee when legally they should not.</p>

<p>According to a Consumer Reports article, in the 1970&#8217;s, President Nixon created the National Commission on State Workmen&#8217;s Compensation Laws to study the terribly-low benefits being given to disabled workers. The committee recommended every state be required to pay 2/3 of the salary of any worker who is totally disabled. To this day, there are still 17 states who don&#8217;t do this for people with no other options for income. Workers compensation not only protects employees, it protects employers in very litigious times.</p>
<p>In many states, a majority of employers STILL operate without the required <a rel="nofollow" onclick="javascript:pageTracker._trackPageview('/outgoing/article_exit_link');" href="http://www.shopinsuranceonline.com/ " target="_blank">workers compensation insurance</a>. And, most of those do not plan to purchase insurance. But, employers MUST have workers compensation insurance if their business meets the minimum requirements in their state of operation. To follow are some ways to implement these cost control measures:</p>

<p>Although Florida&#8217;s workers compensation covers all different genres of jobs and employment in the state of Florida, some businesses try to cheat. That being, they don&#8217;t buy workers compensation insurance for their employees even though they must. Some of the businesses that try to skip over that small detail in Florida are generally construction businesses and employers.</p>

This is especially true if you work in a field that is easy to get hurt on the job.
